Terms and Conditions (aka, the boring stuff)

IMPORTANT: These Terms and Conditions are supplementary to any contract you have with us as an ongoing customer. Please refer to the unique contract you signed upon enrolment.

ESSENTIAL THINGS TO NOTE
Please read all terms and conditions, but be aware in particular of the following as they may be different from other services you have used in the past:
1.1 - Cost of marking and calculation of word count of handwritten work
2 - Up to 2 make up classes per term for year 7-11 students; no make up classes guaranteed for year 12 students
4 - 4 weeks' notice required for cancellations, and cancellation call required to terminate enrolment
5.4.3 - You consent to be charged automatically via any of the payment methods on file for overdue invoices

TERMS AND CONDITIONS
1. Costs and charges
1.1 How is cost of marking calculated?

Marking is $6 per 100 words or part thereof.  
E.g. 1000 words --> $60. 1001 --> $66. 1100 words --> $66.
For typed work, word count is calculated by using 'Select All' (Ctrl+A or Cmd+A) and includes all text in the document.
For handwritten work, we calculate word count as 150 words per standard lined A4 half-page or part thereof. Plans are excluded unless specifically requested.
E.g. 3 handwritten pages + a one-page plan --> deemed 3 pages --> 900 words.
1.2 How are the costs of one-on-one calls calculated?

One-on-one help is $30 per 10 minutes or part thereof. ($180/hr incl GST).
E.g. 10 minutes --> $30. 11-20 minutes --> $60. 45 minutes --> $150.

2. Missed classes and makeup classes
If you are going to miss a class, you must let us know as early in advance as possible so we can organise for you to attend another class, or a make up session.
Missed classes can not be deducted from future invoices.

We offer up to 2 make up classes per term for years 7-11 at no additional cost. Additional missed classes should be made up by arranging to attend other sessions within the same term as the missed classes.
Make up classes will be held during the school holidays after the term in question.
If you are unable to attend make up classes in the holidays, you must let us know in advance to give us the best possible chance at finding alternative arrangements within 2 weeks of the end of term.

Once two weeks have elapsed since the end of the term, make up classes are void. They can not be rolled over into subsequent terms. Refunds are not possible.

Due to the fast-faced and discursive nature of year 12, there are no make up classes. We will endeavour to record classes which are primarily about content rather than discussion, but no guarantees can be made.
For any additional classes missed, or for year 12 students, we recommend attending the weekly workshop to catch up content and ask questions.

3. Refunds
Out of fairness to enrolled students, we have a firm no-refund policy. Regardless of any other statements made generally, unless explicitly provided in writing to a particular private customer at the time of sale, this applies to all programs, intensives, ongoing classes, physical or digital products, or other services we offer. Refunds are strictly not available for any service or programs involving individual or one-on-one help, including consultations. We are firmly committed to providing exceptional service, and we can not do this without committment from our customers.
3.1 Exceptions
3.1.1. Management reserves the right to revoke service at any time for any reason, and is not required to disclose this reason. In this case:
a) Where services have not yet been rendered, we will issue an automatic refund of the amount paid, or cancellation of any amount owing.
b) Where services have already been rendered, refunds are at the sole and exclusive discretion of the proprietor. Absolutely no refunds are available for one-on-one consultations, help, marking or other work. Cost of marking and 1-1 consultations are calculated as described above in (1) and will be deducted from any refundable amount.

4. Cancellations or variations to enrolment
4.1 Notice requirement
If you would like to discontinue or pause any service with us, you must provide 4 weeks' notice. Where an invoice has already been issued and the due date has passed, the full cost of the invoice will be payable.
Example: you have been invoiced for 10 weeks, the invoice is due next week. You can request to cancel and we will bill you only for the next 4 weeks (during which service will continue).
Example: you have been invoiced for 10 weeks, the invoice is 1 hour overdue. Your request to cancel will be effected after the 10 weeks has finished. Service will continue for the full 10 weeks.
4.2 Fee changes
If you leave, pause enrolment, or wish to alter your regular tutoring arrangement in any way, new pricing may apply upon your re-enrolment if it has been enacted since your last agreement started.
4.3 Cancellation call
We require a cancellation call (exit call) with all customers who wish to cancel or vary enrolment. This is only to ask for feedback, but will be required before making any change to payment arrangements.

5. Payment terms
5.1 Yearly payments
We offer a 10% discount if you pay for a full year in advance. A full year is 40 or more weeks. The exact number of weeks will be calculated at the time of payment, and depends on year level. Year 12 is generally 42-43 weeks.
5.2 Automatic billing
If you are being billed automatically, we will send you a reminder that your payment method will be charged at least one day in advance. You may receive more than one reminder. Cancellation periods as described above apply.
If the payment method fails, we will send you a notice and try again.
If the payment method has failed consistently for 3 weeks, your access to service may be suspended.
5.3 Invoices
If you are paying invoices manually, we will send these out with at least 7 days notice (unless otherwise specified).
5.4 Unpaid or overdue amounts
5.4.1. Where invoices are overdue, we reserve the right to add interest for any days overdue at a rate of 6%p.a.
5.4.2. If any payment is overdue or any charge unpaid, we reserve the right to withhold any one-on-one or other service (including marking and one-on-one consultations), regardless of whether or not they otherwise form part of the service agreement. 'Credits' for any one-on-one services (such as marking or consultations) withheld while payment was overdue can be 'unfrozen' after payment is made.
Example: you have been invoiced for 8 weeks of tutoring on a plan that includes marking of 1 essay per week with a 7 day turnaround (8 essays total for the payment time). You are 3 weeks late paying. Any guarantees on marking speed are waived. We can refuse to mark your work in those 3 weeks. Once you are up to date, you will be able to send those 3 essays for feedback (so you will still be able to get 8 essays marked total for that block).
5.4.3. Where invoices are overdue by at least 30 days, you give us consent to charge any payment methods you have used with us previously to bring the balance up to date. We may but are not required to notify you of these automatic charges. You can request a receipt at any time.
5.4.3. Where invoices are consistently unpaid, we will pursue the outstanding amount through debt collection.
